These Terms and Conditions govern access to and use of www.apautodesign.com, as well as the purchase of automotive accessories and related products through our online store.
By placing an order, customers acknowledge that they have read and accepted these Terms and Conditions. Mandatory consumer rights under applicable law remain unaffected.

AP Design is an independent online retailer specialising in automotive styling accessories, exterior modifications and vehicle enhancement products.
We serve private and business customers in Spain, Portugal, throughout Europe and selected international markets.
2. Scope and Acceptance
These Terms and Conditions apply to purchases made through our website and to quotations and orders accepted directly by AP Design.
Product-specific information, including compatibility, manufacturing requirements, availability and delivery estimates, forms part of the conditions applicable to each order.
Any individual quotation or written agreement expressly accepted by both parties shall prevail over these general conditions where relevant and legally permissible.
AP Design may update these Terms and Conditions. Changes will not retroactively modify contracts already concluded.
3. Product Information and Compatibility
AP Design offers automotive accessories including front splitters, side skirts, rear diffusers, spoilers, grilles, aerodynamic components and styling packages.
Product descriptions identify relevant characteristics and vehicle compatibility information to the extent available.
Customers should verify their vehicle's model, generation, production year, body style and any relevant factory equipment before purchasing.
Where compatibility is uncertain, customers are encouraged to contact AP Design before ordering.
Product photographs may include accessories or components not included in the advertised price. The written product description determines the contents of the order.
Minor visual differences may occur due to lighting, photography, manufacturing tolerances or screen settings.
AP Design remains responsible for ensuring that goods conform to their agreed description and applicable legal requirements.
4. Materials, Finishes and Installation
Products may be manufactured from ABS plastic, fibreglass-reinforced materials, carbon fibre or other materials specified in their respective descriptions.
Some products may require professional installation, drilling, bonding, painting or minor fitting adjustments, where clearly indicated.
Installation should be carried out according to the product's characteristics and by appropriately qualified professionals where necessary.
Unless expressly stated, a product should not be assumed to have TÜV, ABE or another type of road-use approval.
Customers should verify local vehicle modification and roadworthiness requirements before installation.
AP Design is not responsible for damage caused exclusively by incorrect installation, misuse or unauthorised modification. This does not exclude liability for defective products, incorrect instructions or other matters for which liability cannot legally be excluded.
5. Prices and Taxes
All prices are displayed in euros (€), unless another currency is expressly indicated.
Prices include VAT or other applicable sales taxes where required by law.
Applicable taxes may vary depending on the destination, customer status and nature of the transaction.
Qualifying exports outside the European Union may be exempt from European VAT, subject to applicable tax rules and export documentation.
Any business-to-business VAT exemption is subject to the relevant legal requirements and verification.
Shipping charges and other mandatory charges collected by AP Design must be disclosed before the customer becomes bound by a purchase.
For international orders requiring an individual quotation, the applicable product price, shipping charges and any charges collected by AP Design will be clearly identified in the quotation.
6. Orders and Payment
Customers must provide accurate contact, delivery and billing information.
Orders submitted through the website are subject to product availability, payment confirmation and the applicable order acceptance process.
AP Design may contact customers to clarify vehicle compatibility, product specifications or delivery requirements.
Payments may be accepted through the payment methods displayed at checkout or specified in an individual quotation, including authorised payment service providers.
For orders requiring manual confirmation, AP Design will communicate the final amount and payment instructions before the customer accepts the quotation.
Payment links may be issued through Stripe or PayPal where available.
Customers should only make payments using authorised links or payment details provided through official AP Design communication channels.
Where advance or partial payments are agreed, the amount, payment schedule and applicable cancellation conditions will be confirmed before payment.
7. Product Availability and Made-to-Order Items
Products may be available for immediate dispatch, supplied on order or manufactured specifically following a purchase.
In-stock products are normally prepared for dispatch according to the timeframe stated on the product page or in the order confirmation.
Made-to-order products may require additional production or procurement time. The applicable estimated timeframe will be communicated before purchase.
Products expressly manufactured according to a customer's individual specifications may be subject to specific cancellation and return conditions.
A product being temporarily unavailable or ordered from a supplier does not, by itself, mean that it is legally classified as personalised.
AP Design will inform customers of significant changes affecting availability or agreed delivery conditions.
8. Shipping and Delivery
AP Design arranges shipping through selected transport providers according to destination, parcel size, weight and product characteristics.
Shipping costs are calculated or quoted separately, unless expressly included in a specific offer.
Delivery estimates depend on the applicable service, product availability and destination.
Delivery periods may be affected by customs inspections, international transport restrictions, severe weather or other circumstances outside the normal shipping process.
Where a delivery date or period has been agreed, any delay will be handled in accordance with applicable consumer law.
Customers must ensure that the delivery address and contact details provided are accurate.
Shipping confirmation and tracking information will be supplied where available.
The risk of loss of or damage to goods passes to consumers in accordance with applicable law and is not transferred merely because a parcel has been dispatched.
9. International Orders and Customs
International shipments may be subject to customs procedures, import duties, local taxes and carrier processing charges.
The amounts and responsibility for these charges depend on the destination, customs classification, manufacturing origin, declared transaction value and agreed delivery terms.
Customers will be informed before completing a binding purchase whether applicable import charges are included in the agreed price or may be collected separately by customs authorities or transport providers.
Import duties and taxes are determined by the relevant authorities and may differ from commercial estimates.
AP Design will provide appropriate commercial and customs documentation for international shipments.
Customs declarations must reflect accurate product information and transaction values.
9.1 United States — Special Shipping and Import Conditions
Orders shipped to the United States are subject to additional international shipping and import-processing requirements.
For US orders requiring an individual quotation, AP Design may apply an international import-processing and handling charge calculated at 20% of the combined product and international shipping price.
This percentage is a commercial estimate intended to contribute to anticipated import-related and processing costs. It is not an official US customs duty or tax rate.
The exact monetary amount of this charge, together with the product price and shipping costs, will be specified in the individual quotation before the customer accepts the purchase.
Where this charge applies, customers will receive a complete written quotation and may accept or decline it before making payment.
Once accepted, payment may be completed using an authorised Stripe or PayPal payment link.
Each quotation will specify whether import duties and related charges are prepaid by AP Design or remain payable to the relevant customs or delivery operator.
AP Design will not impose additional mandatory charges collected by AP Design after the customer has paid an agreed final quotation, except where a further change is expressly and lawfully agreed.
Estimated transit time: 7–15 working days after dispatch, subject to the selected shipping service and customs procedures.
10. Right of Withdrawal and Returns
Consumers benefit from statutory withdrawal and return rights where applicable.
For qualifying distance purchases covered by Spanish and European consumer law, consumers generally have 14 calendar days from receipt of the goods to exercise their right of withdrawal without giving a reason.
To exercise this right, customers should notify AP Design through the contact email provided in these Terms and Conditions or use the withdrawal instructions in our Return Policy.
Customers must return the goods within the statutory period following notification of withdrawal.
Unless otherwise required by law or expressly agreed, the direct cost of returning goods following a change of mind is borne by the consumer, provided that this was properly disclosed before purchase.
For items that cannot normally be returned by post, applicable return-cost information will be provided before the customer enters into a binding contract.
Refunds will be processed according to statutory requirements, including the refund of eligible standard delivery costs.
Where legally permitted, AP Design may withhold a refund until the returned goods have been received or evidence of their return has been supplied.
Exceptions for Personalised Products
The statutory right of withdrawal may not apply to goods manufactured according to the customer's individual specifications or clearly personalised.
This exception does not automatically apply to standard catalogue items merely because they are ordered from a supplier or manufactured after an order is placed.
Exceptions will be identified before purchase when applicable.
These conditions do not affect statutory remedies for defective or non-conforming products.

11. Damaged, Incorrect or Defective Products
Customers are encouraged to inspect their parcels upon delivery.
Visible transport damage, missing items or incorrect products should be reported as soon as reasonably possible.
For efficient investigation, customers are encouraged to provide:

Prompt notification helps AP Design investigate transport incidents and process claims.
However, failure to report an issue within 48 hours does not remove or restrict statutory consumer rights.
Where goods are defective or do not conform to the contract, customers are entitled to the remedies available under applicable law.
These may include repair, replacement, price reduction or contract termination and reimbursement, as appropriate.
12. Legal Guarantee
Products sold to consumers are covered by the statutory legal guarantee applicable to the transaction.
Under Spanish consumer law, new consumer goods are generally subject to a three-year legal conformity period from delivery.
Where the mandatory rules of another jurisdiction apply, the corresponding consumer protection rights will be respected.
The legal guarantee covers qualifying defects and non-conformities. It does not automatically cover damage caused exclusively by accidents, incorrect use, improper installation or ordinary wear.
Nothing in these Terms and Conditions limits rights that cannot legally be excluded.
13. Cancellations and Refunds
Customers who wish to cancel an order should contact AP Design as soon as possible.
Cancellation requests will be assessed according to the stage of the order, product characteristics and applicable statutory rights.
Orders for genuinely personalised goods may be subject to specific conditions, provided these were lawfully disclosed and agreed before purchase.
Where a refund is due under applicable consumer law, it will be processed within the legally required period and normally through the original payment method, unless otherwise lawfully agreed.
Payment provider processing fees will not be deducted from statutory refunds where such deductions are prohibited.
14. Intellectual Property
The AP Design name, branding, original product photographs, descriptions, website content, designs and other protected materials belong to their respective rights holders.
Reproduction, unauthorised commercial use or distribution is prohibited except where permitted by law or expressly authorised.
Third-party vehicle brands and model names are used for identification and compatibility purposes.
Unless expressly stated, references to vehicle manufacturers do not imply official endorsement, affiliation or approval.
15. Privacy and Data Protection
AP Design processes personal information in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR), where applicable.
Personal data may be processed to manage orders, payments, deliveries, customer support and legal obligations.

Cookies and similar technologies are managed in accordance with the applicable Cookie Policy and consent requirements.
16. Liability and Force Majeure
AP Design will fulfil its contractual obligations with reasonable professional care and in accordance with applicable law.
Where circumstances outside our reasonable control affect production, transportation or delivery, customers will be informed where appropriate.
Nothing in these Terms and Conditions excludes or limits liability for fraud, intentional misconduct, statutory product non-conformity or any other liability that cannot legally be excluded.
Mandatory consumer rights concerning delivery, cancellation, refunds and compensation remain unaffected.

Customers wishing to raise a complaint should contact:

18. Governing Law and Jurisdiction
These Terms and Conditions are generally governed by Spanish law, subject to mandatory consumer protection provisions that may apply in the customer's country of habitual residence.
Where consumers are legally entitled to bring proceedings before the courts of their own country, these Terms and Conditions do not restrict that right.
Disputes involving business customers shall be subject to the applicable contractual and jurisdictional rules.
